Judge bars testimony from longtime Jackson doctor (Reuters)

LOS ANGELES (Reuters) ? Michael Jackson's dermatologist will not testify in the trial of Dr. Conrad Murray, a judge ruled on Monday, in a blow to defense plans to portray the singer as a drug addict who may have given himself the substance that caused his death.

Los Angeles Superior Court Judge Michael Pastor also barred witnesses in the case from testifying about Jackson's 2005 trial and acquittal on child molestation charges.

Murray's involuntary manslaughter trial is slated to begin next month over the "Thriller" singer's June 25, 2009, death from what authorities said was an overdose of the powerful anesthetic propofol and other drugs.

Murray has admitted giving Jackson, 50, propofol as a sleep aid, even though it is normally used in a hospital setting. Murray's lawyers have suggested the pop star could have given himself a further dose when his physician was out of the room.

In court papers, Murray's attorneys said they wanted to call Jackson's longtime dermatologist, Dr. Arnold Klein, to the witness stand.

The papers said Klein gave frequent injections of the painkiller Demerol to Jackson for "no valid medical purpose" and that "Jackson became physiologically and psychologically dependent on Demerol."

"I do not think it is relevant," Pastor ruled on Monday. Pastor also barred the testimony of five other doctors, but said he would allow defense attorneys to call two other physicians -- Allen Metzger and David Adams.

Murray was hired as the singer prepared for a series of comeback concerts which had been scheduled to begin in London in July 2009.

The defense contends that Adams told police Jackson was so familiar with propofol that he called it "milk."

Metzger had treated Jackson for two decades, and as recently as two months before the singer's death, Jackson had asked Metzger for intravenous sleep medicine, the court papers from defense attorneys said.

Prosecutors told the judge on Monday that Metzger had turned down Jackson's request.

Pastor on Monday also refused a request by the defense to bring up a 2003 raid of the singer's Neverland Ranch in California, in which defense attorneys said propofol and Demerol were found.

Murray's team had said in court papers that they did not plan to refer to the child molestation charges on which Jackson was later acquitted.

Pastor said testimony about the Neverland raid would be "irrelevant" and that it "proves absolutely nothing" involving Jackson's 2009 death.

Murray has pleaded not guilty to involuntary manslaughter. He faces up to four years in prison if convicted.

Jury selection in the case is due to begin on September 8 and opening arguments are set for September 27.

August consumer confidence lowest in more than two years (Reuters)

NEW YORK (Reuters) ? Consumer confidence crumbled in August to its lowest level in more than two years as the fallout from political wrangling over a budget deal took its toll, according to a private sector report released on Tuesday.

The Conference Board, an industry group, said its index of consumer attitudes sank to 44.5 from a downwardly revised 59.2 the month before. The index was well off a poll of economists by Reuters for a reading of 52.0.

The index was at the lowest level since April 2009, the report said. July was originally reported as 59.5.

Consumers' outlook also deteriorated sharply as the expectations index plunged to 51.9 from 74.9. The assessment of consumers' present situation fared better with the index slipping to 33.3 from 35.7.

Consumers have faced many hurdles recently, including the debate surrounding the debt ceiling, the downgrade of the U.S. credit rating by Standard & Poor's, volatility in financial markets and increased fears the economy is heading for another recession.

"A contributing factor may have been the debt ceiling discussions since the decline in confidence was well underway before the S&P downgrade," Lynn Franco, director of The Conference Board Consumer Research Center, said in a statement.

Consumers' labor market assessment also worsened. The number of respondents saying they found "jobs hard to get" rose to 49.1 percent from 44.8 percent the month before, while the "jobs plentiful" category fell to 4.7 percent from 5.1 percent.

The view on prices increases was unchanged with expectations for inflation in the coming 12 months holding steady at 5.8 percent.

Chavez set to begin new round of cancer treatment

President Hugo Chavez thanked Venezuelans on Sunday for praying for his health as he undergoes a third round of chemotherapy at a military hospital in Caracas, this time getting the cancer treatment at home rather than Cuba.

Chavez walked into the Dr. Carlos Arvelo Military Hospital accompanied by his daughter Rosa and aides late Saturday. He said his treatment has been going well and aims to prevent reappearance of cancer cells more than two months after he underwent surgery.

"From here, I join all these prayers and masses for the health of all of us," Chavez tweeted Sunday. "God bless you!"

"I want to salute and congratulate all the employees that work at our marvelous Military Hospital," he added in another tweet.

State television broadcast footage of a prayer meeting in Chavez's home state of Barinas, where dozens of Venezuelans listened to a priest who urged government supporters to pray for the president's quick recovery.

"We love you ? your mother, your father and your brothers and all of your family and friends," Chavez's father, Hugo de los Reyes Chavez, said at the prayer meeting. "All the people love you very much."

"Take care of yourself in this battle," he added.

Before entering the hospital, Chavez said on television Saturday that he and his team of Cuban and Venezuelan doctors decided it would be all right for him to undergo chemotherapy in Venezuela after his latest round of medical tests Friday.

"I'm determined to continue living," Chavez said at the hospital. "It's not time to die. What we have to do still is a great deal."

Chavez, who was first elected in 1998, has vowed to bounce back and win re-election in 2012.

Before going to the hospital, Chavez appeared on a balcony of the presidential palace waving to a crowd of cheering supporters. They included a group that played Afro-Venezuelan music, beating on drums and dancing. Some chanted: "Onward, commander!"

Chavez expressed optimism that he is overcoming cancer, referring to the "illness I had." He said he was making arrangements with his vice president, Elias Jaua, and other officials in order to "continue with this rhythm of treatment."

Chavez underwent surgery in Cuba that removed a cancerous tumor from his pelvic region in June. He has not specified where the tumor was located but said the latest follow-up tests haven't detected any sign of malignant cells in his body. He said the chemotherapy is a preventive measure.

Chavez has appeared with his head shaved the past few weeks after his hair began to fall out as a result of chemotherapy.

The president said during a televised Cabinet meeting on Saturday that he expects to disappear from public view in the coming days but will remain in contact with government officials and his supporters by phone and Twitter.

"In the coming hours, between today and tomorrow we'll be preparing for the third cycle," Chavez said.

Obama invokes Sept 11 attacks in call for service (Reuters)

WASHINGTON (Reuters) ? President Barack Obama urged Americans on Saturday to recall the spirit that united the country after the September 11 attacks and take part in a national day of service to mark the anniversary next month.

In remarks acknowledging the "great challenges" that confront the U.S. economy, and could hurt his reelection chances next year, Obama also sought to rise above the partisan political rancor that has divided Washington all summer.

"As we mark this solemn anniversary, let's summon that spirit once more. And let's show that the sense of common purpose that we need in America doesn't have to be a fleeting moment; it can be a lasting virtue," Obama said in his weekly radio address.

With unemployment stuck above 9 percent, Democrat Obama is fighting for more measures to boost growth and hiring but has been thwarted so far by Republicans in Congress, who control the House of Representatives.

He will unveil a package of employment-creating measures in a major jobs speech after the September 5 Labor Day holiday which White House aides say will contain a number of new proposals.

Obama and his wife Michelle will mark the 10th anniversary of the attacks by visiting Ground Zero in New York, the Pentagon, and the site in Shanksville, Pennsylvania, where the fourth hijacked airline crashed after its passengers .

"But even if you can't be in New York, Pennsylvania or Virginia, every American can be part of this anniversary. Once again, 9/11 will be a National Day of Service and Remembrance," Obama said.

The attacks, blamed on Osama bin Laden's al Qaeda extremist network, killed nearly 3,000 people in September 2001. Bin Laden was killed earlier this year in an attack on his compound in Pakistan and his network has been splintered and weakened by repeated attacks by allied western forces in recent years.

El Salvador recognizes Palestine as independent state (Reuters)

SAN SALVADOR (Reuters) ? El Salvador on Thursday recognized Palestine as an independent state in the midst of a drive by the Arab League to upgrade it to full membership status in the United Nations.

"This decision was made in the context of the profound respect El Salvador has for sovereign decisions by members of the United Nations, the majority of whom have recognized the Palestinian state," El Salvador's President Mauricio Funes told a news conference.

Full member status would require approval in the U.N. Security Council, where Israel's ally the United States has said it will veto any such resolution.

Funes, who belongs to the left-wing Farabundo Marti National Liberation Front, said he hoped his decision would help foster peace in Israel, adding that he supported the country's right to maintain secure borders.

About 120 countries have recognized the state of Palestine to date.

The Palestinians, who currently have U.N. "observer" status, had previously pledged to seek U.N. endorsement in September for their claim of sovereignty in the Gaza Strip, and the Israeli-occupied West Bank and East Jerusalem.

The move has gained momentum with the lack of progress in Israeli-Palestinian peace negotiations. The Arab League formally backed this plan in May.

Saldana is a long way from Pandora these days as she promotes her new film, "Colombiana." Tuesday night she sported a pink leather mini dress, above left,?in Los Angeles for a screening of the film. This look dialed back the gold-and-white drama she brought to?the red carpet in Miami, second from left. The black tuxedo-jacket number is also from Miami and the far right, shimmery dress showed up at the Teen Choice Awards?on Aug. 7.

Each patent relates to a separate variety of grape: Sweet Scarlet (U.S. Patent No. PP15,891), Scarlet Royal (U.S. Patent No. PP16,229), and Autumn King (U.S. Patent No. PP16,284).? The?California Table Grape Commission is a?branch of the California?state government that operates with the mission of promoting the California table grape industry and is funded by a tax on grape production.? The USDA granted the Grape Commission an exclusive license to practice and sublicense the varieties. The Grape Commission then began selling plants, but only to?nurseries?that contractually agreed to (1) pay ongoing royalties and (2) not propagate the plants.

In 2007, a collection of nursery-licensees filed a declaratory judgment lawsuit challenging the validity of?the patents and arguing that the Grape Commission's licensing activities were illegal under antitrust law.

The DJ plaintiffs quickly ran into trouble based on federal sovereign immunity claims:?The USDA claimed sovereign immunity from suit in the district court.? The district court dismissed the lawsuit after concluded that the USDA was immune and (as patent holder)?was?also an?indispensable party.

On appeal, the Federal Circuit agreed that the USDA was an indispensable party but held that the agency's sovereign immunity to a DJ invalidity and unenforceability action was waived by the Administrative Procedures Act.

Patent-Holder as Necessary Party: Normally, a patent holder is a necessary and indispensable party to a declaratory judgment lawsuit arguing that patents are invalid or unenforceable.? There is, however, a narrow exception that occurs when the patent holder has transferred ?all substantial rights? to an exclusive licensee.? Here, the appellate court found that the USDA retained substantial rights because the exclusive license did not give the Grape Commission unilateral rights to enforce the patents and the USDA retained a right to practice the invention.

US Government?is Not Immune from a Declaratory Judgment Patent Invalidity Lawsuit in Federal Court:?As a general background rule,?US government agencies are immune from suit unless that immunity has been waived. Here, the plaintiffs found such a waiver in Section?10(a) of the Administrative Procedures Act as codified in 5 U.S.C. ? 702 (?Right of Review?).? That section indicates that ?a person suffering legal wrong because of agency action ? is entitled to judicial review thereof.???The statute particularly authorizes a lawsuit to remedy the?wrong in Federal Courts ? so long as the remedy being?sought is something ?other than money damages.?? As interpreted by the Federal Circuit, this provision (as amended in 1976) ?consists of a broad waiver of sovereign immunity for actions seeking relief other than money damages against federal agencies, officers, or employees.??

Here, because the DJ plaintiffs are only seeking non-monetary equitable relief ? a holding that the PVPA patents are invalid and unenforceable ??their claim is wholly within the APA Section 10(a) waiver and wholly outside?the jurisdiction of?the Court of Federal Claims.

On remand, the government will now be forced to defend the validity of its patent.

Man arrested for hate crime in Ore. mosque fire (AP)

EUGENE, Ore. ? Federal officials arrested a 24-year-old man on charges of firebombing an Oregon mosque last year and said he was motivated by racial hatred following the arrest of a Muslim man accused of plotting to set off a car bomb in Portland.

Cody Crawford, who has been under investigation since the Corvallis mosque was torched Nov. 28, was arrested Wednesday night at a home in the nearby town Monmouth. Officials said he did not resist arrest.

Crawford was indicted on charges of damaging religious property for racial reasons, which is a hate crime, and using fire to commit a felony.

"This was an attack on religious freedom and an attack on the American way of life," said Dwight Holton, U.S. attorney for Oregon.

The mosque firebombing occurred just two days after FBI agents arrested a Somali-American, Mohamed Osman Mohamud, in a sting operation at Portland's annual Christmas tree lighting ceremony. Mohamud was charged with plotting to kill people at the ceremony by igniting a car bomb.

Mohamud had occasionally worshipped at the Corvallis mosque.

The mosque's office burned, but nobody was hurt.

Crawford appeared briefly in court Thursday and was ordered held in jail while legal proceedings go forward. He did not enter a plea.

Assistant U.S. Attorney Bud Fitzgerald said Crawford has bipolar disorder and is an alcoholic ? and would be a flight risk if released.

Court documents show that three weeks after the mosque firebombing, in unrelated encounters with police, Crawford ranted about Muslims, said Christians are capable of jihad and told an officer he resembled President Barack Obama.

"You look like Obama. You are a Muslim like him. Jihad goes both ways. Christians can jihad too," a court document quotes Crawford as telling a McMinnville officer Dec. 14.

The document says Crawford told officers "only Christians could understand him, that he was a Christian warrior that they were persecuting," and that "you will never know the truth about the mosque."

Crawford also said he did not torch the mosque, according to the affidavit.

Crawford had been arrested Dec. 14 after causing a disturbance at a gas station by shining a flashlight at a car, "talking about terrorists and Muslims," and telling a witness he would "come back and kill you if you call the cops," according to the document.

Crawford was arrested again Dec. 16, this time in Corvallis, for waving a knife around in his front yard, authorities said. He was taken to a local hospital for a mental evaluation, where he told a detective, "If you believe in jihad, you're working for the wrong God. You're a jihadist." Crawford also said, "Muslims are cool. Jihadists are not."

Law enforcement officers began looking at Crawford as a possible suspect in the firebombing early in the investigation.

Federal and local officials questioned people living in the neighborhood, including Crawford, who was living with his mother and sister. When officers showed Crawford a blue Maglite flashlight they had found outside the mosque, Crawford told them it looked like his.

In a search of his house, police and the FBI took DNA samples and seized computers, digital camera equipment, a gas can and other evidence.

According to the court document, lab tests showed Crawford is a "potential major contributor" of DNA on the flashlight found near the mosque.

As they analyzed Crawford's computer, investigators found that in a Facebook update the day after the FBI sting, Crawford wrote he had seen Mohamud at the Corvallis mosque.

"That guy on the news used to go to the mosque that is right in frnt (sic) of my house," the Facebook post read, according to the court document.

On Nov. 27 and 28 Crawford conducted numerous Internet searches for news articles about the Portland bomb plot, the affidavit states.

After his house was searched last year, neighbors described Crawford as a sweet young man who loved going to the local community college and was a good dad to his 4-year-old boy.

But Crawford has had frequent run-ins with police. In years past he has been accused of assault, breaking a window when he was in jail, throwing a cup of urine at a deputy, dealing drugs, burglary, criminal trespassing and other crimes.

Even Crawford's relatives have expressed worry about his behavior. After he was thrown into a county jail in 2009, his sister told a sheriff's deputy he was "delusional," that he "had not been himself lately" and that he said he worked with the CIA, according to a sheriff's office report.

His mother said last year that Crawford has been diagnosed with high-functioning autism. She declined to comment when reached on her cell phone Thursday.

In an interview with The Associated Press last December, Crawford said he is "100 percent innocent" of the mosque firebombing, that he's a peaceful person and that he does not dislike Muslims.

"They're all just normal people. We are all people," Crawford said at the time.

If convicted on both counts, Crawford faces a mandatory minimum of 10 years in prison, and a maximum of 30 years.

U.S. alert as Hurricane Irene threatens East Coast (Reuters)

SANTO DOMINGO (Reuters) ? Hurricane Irene posed a potential threat to the entire U.S. East Coast from Florida to New England, U.S. officials said on Tuesday, as forecasters tried to predict where the powerful storm might hit over the next week.

U.S. Federal Emergency Management Agency (FEMA) Administrator Craig Fugate and National Hurricane Center Director Bill Read issued the warning as Irene swept up from the Caribbean on a northwest track toward the United States.

"We're going to have a very large tropical cyclone move up the Eastern Seaboard over the next five to seven days," Read told a conference call in which he spoke along with Fugate.

The FEMA chief said residents all along the East Coast should be alert not only to a potential direct landfall but also to the risk of torrential rains, high winds and flooding that Irene could bring.

"We're saying the entire East Coast," Fugate said.

Irene, now a Category 2 storm, was heading on Tuesday over the Turks and Caicos Islands and southeastern Bahamas. It was expected to become a major Category 3 storm, with winds over 111 mph, by Wednesday and could possibly intensify further to a Category 4 as it neared the southeast U.S. coast by Friday.

Calling Irene a "very large storm," Read said the Miami-based NHC's "best guess" forecast at the moment was that the hurricane would approach the coast of the Carolinas on Saturday morning as a major storm, of Category 3 or upward on the five-step Saffir-Simpson scale of intensity.

Read said the storm will skirt south Florida but added that after the Carolinas, the New England region of the East Coast could also be at particular risk.

"We're going to potentially see tropical storm-force conditions, very hazardous beach conditions," Fugate said, adding evacuations of coastal areas could be needed.

Irene, the first hurricane of the busy 2011 Atlantic season, looks set to be the first hurricane to hit the United States since Ike pounded the Texas coast in 2008.

At 11 a.m. (1500 GMT), Irene had top winds of 100 miles per hour and was 70 miles south of Grand Turk Island in the Turks and Caicos and 50 miles north northwest of Puerto Plata, Dominican Republic.

Hurricane force winds extended outward up to 50 miles from Irene's center and tropical storm force winds extended out up to 205 miles, the NHC said.

Migrant and seasonal workers Agricultural Worker Protection Act, or MSPA was signed into law in 1983, and replaces the old farm labor contractor registration act. As the name implies, is used to certain safeguards and protections for migrant and seasonal workers, agricultural workers. Since migrant workers are less likely to be able to organize themselves and fight for their rights, provides the basic rights MSPA for these workers and employers to take advantage of the preventionthem. Most of the Act outlines the rights and provisions for the protection of these rights.

The main provisions of the MSPA include:

The employer agreed to terms with all the employees.

The employer must all wage and salary for all employees and all hold for at least three years.

It is important to note, however, that these provisions only for actual employees, notindependent contractors. Ices were first made for the upper classes who lived in fine houses and were able to have an ice house where large blocks of ice would be stored. If you are thinking of collecting ice cream molds you will find many cheap and cheerful examples but if you want to become a serious collector you will find items made from silver or silver gilt which would cost a pretty penny. A pair of George III silver gilt ice cream serving spade and forks were sold at Bonhams a couple of years ago for £4,800.

The first ices were water ices and appeared in France and Spain in the early 1660s. The first record we have of ices being served in England was at Windsor Castle in 1671. As more ice houses were built on the English Country Estates ices became popular and were often served at upper-class dinners. Early versions would have been made with cream, sugar and fruit and possibly flavourings, from the middle of the 18th century egg yokes were added which would have given a richer, smoother flavour.

They would have been made in a pewter pot which was placed in a wooden bucket containing the ice to aid the freezing process. It was then placed into hinged pewter or lead molds which were often fruit shaped, as pineapples or lemons. Ice cream really become popular in Victorian England and large quantities of ice was imported from Norway and north America for ice houses in people?s gardens or basements. Victorian cooks would have known how to make them for the dinner parties and they were shaped in molds as fruits or vegetables ? asparagus was particularly popular. Brick-shaped molds were used for Neopolitan ices in different colours and pillars and bombs were very popular. There were many novelty shapes such as swans, elephants and anarchist bombs as well as the Statue of Liberty and Cleopatra?s Needle.

If you want to start collecting ice cream molds there is a huge selection and you will not find it difficult to find the more common shapes, especially fruit moulds. It is harder to find the rare fruit shapes like quince and the novelty shapes are not easy to find. When you find your mold make sure it is in good condition. The inside should be shiny, not pitted or flaking and the mold should close tightly. Prices start at around £5 for a tin mold, £10 for a copper mold and £20 for a pewter mold, but you could pay a lot more for special examples. Many collectors buy ice cream molds for display rather than use and you should be especially careful about using lead ice molds.

During the second half of the 19th century ice cream finally became available to the masses and they were sold by street vendors. The ?penny lick? was served in a small glass and these glasses are now highly collectable ? you can usually get one for around £50. These glasses were wiped clean and re-used and were finally outlawed in 1926 as they were thought to spread diseases. Around the end of the 19th century edible cones were invented and the ice cream as we know it was born. The first mobile ice cream vans appeared at the beginning of the 20th century. The Walls ice cream tricycle was first seen in 1923 using the famous slogan ?Stop Me and Buy One?. These were seen all over the country until after World War II when we began to see freezers in the shops. The 1950s and 1960s saw the introduction of the ice cream van and the parlour. There are a wealth of collectables to be had from this era such as model ice cream vans ? most of us couldn?t find the money to buy the real thing. The coloured glass dishes and long spoons used in the ice cream parlours of the day are the ice cream molds of the mid 20th century and they are not difficult to find and affordable. As the current trend in kitchens is retro you could be right in the fashion.

Everybody loves ice cream and we all seem to think that it has always been around as a cheap treat for the children. Nothing could be further from the truth. Ices were first made for the upper classes who lived in fine houses and were able to have an ice house where large blocks of ice would be stored. If you are thinking of collecting ice cream molds you will find many cheap and cheerful examples but if you want to become a serious collector you will find items made from silver or silver gilt which would cost a pretty penny. A pair of George III silver gilt ice cream serving spade and forks were sold at Bonhams a couple of years ago for £4,800.

The first ices were water ices and appeared in France and Spain in the early 1660s. The first record we have of ices being served in England was at Windsor Castle in 1671. As more ice houses were built on the English Country Estates ices became popular and were often served at upper-class dinners. Early versions would have been made with cream, sugar and fruit and possibly flavourings, from the middle of the 18th century egg yokes were added which would have given a richer, smoother flavour.

They would have been made in a pewter pot which was placed in a wooden bucket containing the ice to aid the freezing process. It was then placed into hinged pewter or lead molds which were often fruit shaped, as pineapples or lemons. Ice cream really become popular in Victorian England and large quantities of ice was imported from Norway and north America for ice houses in people?s gardens or basements. Victorian cooks would have known how to make them for the dinner parties and they were shaped in molds as fruits or vegetables ? asparagus was particularly popular. Brick-shaped molds were used for Neopolitan ices in different colours and pillars and bombs were very popular. There were many novelty shapes such as swans, elephants and anarchist bombs as well as the Statue of Liberty and Cleopatra?s Needle.

If you want to start collecting ice cream molds there is a huge selection and you will not find it difficult to find the more common shapes, especially fruit moulds. It is harder to find the rare fruit shapes like quince and the novelty shapes are not easy to find. When you find your mold make sure it is in good condition. The inside should be shiny, not pitted or flaking and the mold should close tightly. Prices start at around £5 for a tin mold, £10 for a copper mold and £20 for a pewter mold, but you could pay a lot more for special examples. Many collectors buy ice cream molds for display rather than use and you should be especially careful about using lead ice molds.

During the second half of the 19th century ice cream finally became available to the masses and they were sold by street vendors. The ?penny lick? was served in a small glass and these glasses are now highly collectable ? you can usually get one for around £50. These glasses were wiped clean and re-used and were finally outlawed in 1926 as they were thought to spread diseases. Around the end of the 19th century edible cones were invented and the ice cream as we know it was born. The first mobile ice cream vans appeared at the beginning of the 20th century. The Walls ice cream tricycle was first seen in 1923 using the famous slogan ?Stop Me and Buy One?. These were seen all over the country until after World War II when we began to see freezers in the shops. The 1950s and 1960s saw the introduction of the ice cream van and the parlour. There are a wealth of collectables to be had from this era such as model ice cream vans ? most of us couldn?t find the money to buy the real thing. The coloured glass dishes and long spoons used in the ice cream parlours of the day are the ice cream molds of the mid 20th century and they are not difficult to find and affordable. As the current trend in kitchens is retro you could be right in the fashion.
