Judge Orders Maryland Dept. of Human Resources to Cease ...

Silver Spring, MD, August 30, 2012 ?(PR.com)? In a ruling that is startling in its implications, a Montgomery County Circuit Court judge has ordered the Maryland Department of Human Resources (DHR) to refrain from the abusive tactics it has pursued in shutting down a 40-year-old business that serves adolescent children in the Maryland/DC metro area.

In his July 27, 2012 decision granting a preliminary injunction favoring the Koba Institute, Judge Eric M. Johnson ruled:

?[P]ublic interest mandates that this Court issue a preliminary injunction. More specifically, this Court finds that Defendant MDHR?s failure to follow governing regulations are public interest issues that warrant issuing a preliminary injunction.?

By calling this a public interest matter, Judge Johnson has clearly indicated that the harm caused by DHR?s actions is not limited solely to the damage done to Koba. It affects the entire public at large.

Koba Institute, Inc. has operated a group of five residential child care facilities in Anne Arundel, Montgomery and Prince George?s Counties for over 20 years. The facilities are licensed by DHR, and they comprise one of the largest high intensity residential child care programs in the state.

In October 2011, Darlene Ham, the new Interim Executive Director of DHR?s Office of Licensing and Monitoring (OLM), issued a ?Letter of Intent to Revoke? (LIR) Koba?s licenses without giving Koba prior notice. This action violated several sections of the Code of Maryland Regulations (COMAR). DHR also set a moratorium on new referrals to Koba from its county-level agencies ? even though it never actually revoked Koba?s licenses.

On February 27, 2012, Judge Johnson issued a temporary restraining order (TRO) against DHR, finding that Koba had suffered ?irreparable harm? because of:

?Defendant?s unwillingness to issue an explanatory and clarifying letter regarding Plaintiff?s current posture in the administrative proceedings.?

DHR continued its moratorium on new referrals from DHR local agencies, and on May 1, 2012, Ms. Ham sent a letter to 24 social service agencies, including agencies in the District of Columbia, instructing them not to refer residents to Koba?s homes. However, though no new referrals were forthcoming, no agency ? not even DHR?s county-level agencies ? took action to remove the residents already housed in Koba?s homes at any point after the LIR was issued. This speaks to the high regard these agencies have for Koba?s programs.

In reference to DHR?s moratorium on referrals, Judge Johnson found in his July 27 preliminary injunction that:

?Plaintiff is likely to succeed on the merits of its claims that Defendant [DHR] failed to follow governing administrative regulations in the notice, violation and sanctions process employed by MDHR in placing the Koba Institute, Inc. on the ?hot list? by not following regulations pertaining to COMAR 07.05.01.18 and 07.05.01.19, which require that prior to sanctions or a suspension being imposed, Plaintiff must be notified of the violation(s) and given the opportunity to cure the violation.?

In spite of DHR?s actions, Koba has sought an amicable solution to this crisis. In March 2012, Koba sent a letter to Theodore Dallas, secretary of DHR, requesting that DHR officials take part in mediation, retract the department?s intention to revoke Koba?s licenses, follow COMAR, and once again regard Koba as an organization in good standing. These efforts were to no avail.

DHR?s actions have caused significant economic harm, not only to Koba and the 50 members of its staff who have been laid off, but also to those with whom we do business.

Koba continues to fight DHR?s illegal and destructive actions. Virtually every substantive decision made by the Montgomery County Circuit Court, up to and including Judge Johnson?s preliminary injunction, has been in Koba?s favor. Yet, DHR has decided to prolong this fight through judicial procedures that hide behind ?sovereign immunity.?

That is why Judge Johnson, in observing the extent of COMAR violations perpetrated by OLM under DHR?s Social Services Administration, headed by Ms. Carnitra White, held:

?Defendant MDHR?s failure to follow governing regulations are public interest issues that warrant issuing a preliminary injunction.?

Furthermore, in his preliminary injunction, Judge Johnson commented on a prior decision of the Office of Administrative Hearings, which was based on the LIR:

?ORDERED, that Defendant MDHR and/or any of its agents are hereby enjoined from considering the ruling of the administrative hearing.?

Nevertheless, DHR has failed to act in good faith to respect the orders in this and other rulings by the circuit court. Koba has sent a second letter to Secretary Dallas, detailing and documenting the full range of DHR violations and enforcement mistakes. Because of the ?public interest? involved in this case, Koba has also asked the relevant committees of the Maryland Senate and House of Delegates to initiate hearings on this matter brought to their attention by the circuit court.

Daily Kos: When Adam Comes Marching Home

On August 8th, 2012 my son returned safely home from his deployment to Afghanistan. I would like to like to thank family, friends, coworkers and the complete strangers who offered support to Adam, my wife and me. Not a single person who learned of his combat tour failed to thank him for his service and express concern for his safety. The Afghanistan War is not foremost in the minds of Americans as they go about the daily grind of getting and spending that is our life. However, when reminded that military men and women are still fighting and dying, people are gracious, thankful and humbled by their sacrifice.

When we learned that Adam was coming home from Afghanistan, the relief was palpable. He was posted to a country where a sizable percentage of the population was actively trying to kill him and for five months we had tried to suppress those thoughts and concerns. We knew that his job would take him ?over the wire? and into the combat zone. This was especially difficult for my wife because mothers never stop worrying in the best of times. We did not know how often and how dangerous those missions were until we saw the pictures of Adam in full battle armor and of Marine vehicles destroyed by IEDs.

The journey home from Afghanistan took several days, yet thanks to social media and cell phones, he kept us informed of his progress each leg of the journey. The first stop was Kyrgyzstan, where they had a day and a half layover. He was still in a far off ?stan, but no longer in a war zone. Thanks to Facebook updates we learned that the next stop was Germany, then after landing in Maine, he texted that he was finally back in the United States.

We were told to arrive at Camp Pendleton for the homecoming at 8pm. The Marines would land at March AFB and be bused to parade ground where we would meet. The buses had to first stop at the armory, so they could all turn in their weapons. At 8pm that evening everything was going according to plan, Adam?s friends and family were all arriving on the base and he texted that they had just driven through the gates, as well.

As expected, the scene at the parade ground was the exact opposite of melancholy and trepidation we experienced months ago when he first deployed. Joyful anticipation was the prevailing mood. Smiles, laughter, nervous banter and lots of children turned the wait into a celebration. The Marines supplied hot dogs and dessert for the gathering. There were many welcome home signs, including a large 3D sign my wife created for Adam. There was no mistaking, this was a celebration.

The separation from their families took varying tolls on the returning Marines. One of the most touching sights was a mother holding a four month old baby, who had yet to meet her father. On the other hand, we spoke with a wife who said all the right things to us, but as soon as they returned home that night she informed her husband she was divorcing him. The casualties of war are not all on the battlefield.

Lest we forget, there are still men and women dying in Afghanistan. Adam now wears a black wristband in memory of one of his sergeants, killed in a ?green on blue? attack when an Afghan soldier opened fire on a group of Marines.

The 9pm arrival time came and went and calls to the Marines on the bus revealed that the count of weapons turned in to the armory did not match the master list. It took over two hours and three separate tries; including pulling all the weapons back out and starting over from scratch before the count matched and the buses finally were allowed to proceed to the parade ground and the homecoming reunion we had all been anticipating.

The six white buses finally drove onto the parade ground. They parked in a line, bumper to bumper and doors facing away from the waiting crowd. The Marines disembarked and assembled in formation, hidden from us by the buses. When they were empty, the buses drove off, leaving the returning Marines 100 feet away from their friends and family. There was a slight pause and then in a scene that resembled the start of a battle from ?Braveheart?, the two sides advanced on each other and came together in the middle, except instead of clubs and swords, these warriors were met with tears, hugs and kisses.

The returning Marines had 96 hours of leave coming, but school and work the next day loomed for the most of the others. The parade ground quickly emptied, home and private reunions beckoned. Adam had not eaten since landing in Maine, so at 2am we ended our day with the meal he had been anticipating the entire time he was in Afghanistan. A San Diego restaurant, Slater?s 50/50, makes a half ground beef and half ground bacon hamburger, topped with a fried egg, add a beer and surrounded by friends, family and Marine buddies it was an All-American end to a much anticipated day. ?

Ann brings the love as Romney wraps up nomination

Republicans crowned Mitt Romney the presidential nominee as his wife Ann sold their wholesome family and college sweetheart love story to US voters in a prime-time convention speech.

Romney took to the stage at the packed convention center in Tampa, Florida to proffer a polite thank you kiss as part of a carefully choreographed attempt to reintroduce the sometimes awkward candidate as a loving family man.

The 65-year-old multi-millionaire businessman will formally take up the nomination with his all-important acceptance speech on Thursday, the climax of three days of rousing convention addresses by party grandees and rising stars.

Romney lies neck-and-neck with Democratic President Barack Obama in national polls ahead of a November election that should be the challenger's for the taking, given the sour economy and stubbornly high unemployment.

Romney's campaign has been eager to promote the gregarious, 63-year-old Ann as a conveyer of the family story, a mission intended to humanize a candidate who trails Obama badly in terms of likability and can come across as stiff.

She delivered her side of the bargain, blending a targeted pitch to vital women voters with a personal narrative about Mitt that dwelt largely on their all-American love story, their wholesome family and his winning attitude.

"This man will not fail," Ann Romney said, staring in determined fashion right at the lens in an address beamed live into American living rooms just 10 weeks before voters go to the polls.

"This man will not let us down. This man will lift up America!"

After a series of wealth-related gaffes during the campaign, she repeatedly invoked their love story as college sweethearts as she sought to portray the Romneys as an everyday couple who shared hardships just like other Americans.

"It has been 47 years since that tall, kind of charming young man brought me home from our first dance. Not every day since has been easy. But he still makes me laugh. And never once did I have a single reason to doubt that I was the luckiest woman in the world.

"You can trust Mitt," she said. "He loves America. He will take us to a better place, just as he took me home safely from that dance."

Earlier, in a state-by-state roll call of delegates on the convention floor that reflected the results of the Republican primary elections, Romney soared past the 1,144 threshold to formally earn the nomination.

Charismatic New Jersey Governor Chris Christie followed Mrs Romney on stage, giving the keynote address and firing up the crowd with a tear-down of Obama that failed to hide his own ambitions for a potential presidential run in 2016.

The convention kicked off earlier Tuesday with the usual blend of political theater and razzmatazz despite the hurricane bearing down on New Orleans, which derailed Monday's opening and still threatened to cast a pall over proceedings.

Many Americans do not tune in until the convention season starts -- Obama and the Democrats hold theirs next week in Charlotte, North Carolina -- so Tampa provides Romney with a golden opportunity to buff up his image.

The run-up to the convention was marred by incendiary remarks from Todd Akin, a Republican congressman seeking a Senate seat in Missouri, who suggested women's bodies spontaneously prevent pregnancy after a "legitimate rape."

The Romney camp, which roundly condemned the remarks, is keen to get back on message, pressing the case that the former Massachusetts governor understands the economy better than Obama and knows how to get the country back on track.

Republican delegates said Romney was on course to take the White House as the American people recognized Obama's "hope and change" mantra had worn thin after four years of economic hardship.

"The president can smooth talk anything but I think nobody wants to listen to that anymore," Tina Gibson from Texas, wearing a star-spangled banner outfit complete with cowgirl hat, told AFP on the convention floor.

Obama has broken with tradition and is campaigning hard through his rival's event, countering Romney's bid to grab an uninterrupted chance to make his case.

"This week in Tampa my opponents will offer you their agendas. It should be a pretty entertaining show -- I'm sure they will, you know, have some wonderful things to say about me," he said Tuesday in the key swing state of Iowa.

"But what you won't hear from them is a path forward that meets the challenges of our time."

New maps may reduce tourism impacts on Hawaiian dolphins

ScienceDaily (Aug. 27, 2012) ? Over-eager tourists intent on seeing spinner dolphins up close may inadvertently be disturbing the charismatic animals? daytime rest periods and driving them out of safe habitats in bays along Hawai?i?s coast. But a study led by researchers at Duke and Stony Brook universities gives scientists and resource managers a promising new tool to curb the frequency of the repeated human disturbances and help reduce their negative impacts.

?Using the maps produced through this study we can identify the bays where the effects of human activities on spinner dolphins should be monitored most closely, and where immediate conservation actions are required,? said David W. Johnston, research scientist at Duke?s Nicholas School of the Environment.?

?The mapping models developed by the researchers indicated that only a small number of bays ? 21 out of 99 ? in a study area along the western coastlines of the main Hawaiian islands were suitable habitats for resting dolphins. Knowing this, Johnston said, ?conservation efforts can be focused on specific areas of importance.??

?We may be able to minimize detrimental effects on dolphins by putting restrictions or preventative measures into place in a relatively small number of bays, rather than limiting access to dolphins along the entire coast,? said the study?s lead author, Lesley H. Thorne, a lecturer in marine science at Stony Brook University, who received her PhD from Duke in 2010. ?That benefits tourists and tourism operators as well as the dolphins.??

To create the new mapping models, the researchers used the geographic coordinates and key environmental factors ? such as water depth, the size and proportions of the bays, and proximity to deep-water foraging grounds ? for hundreds of spinner dolphin sightings made throughout the study area between 2000 and 2010.?

?Spinners are small dolphins famed for their graceful aerial movements and balletic spins. Found in tropical and subtropical oceans around the world, coastal populations of the animals divide their time between daytime rest periods in shallow, protected bays and nighttime foraging in more exposed waters.?

Distinguishing between sightings of resting and active dolphins was key to defining critical habitats, Thorne said, because while socially active spinner dolphins are more tolerant of humans? presence, resting dolphins will leave the safety of a bay and retreat to less suitable open waters if they are repeatedly interrupted.?

?Sleep is essential for most animals,? added Johnston. ?When deprived of their necessary ?zzzz?s,? they gradually show a decreased ability to process information and remain attentive to environmental stimuli. In technical lingo, we call this a ?vigilance decrement?.??

Spinner dolphins are no exception to the rule, he said. Over time, dolphins that are harassed by people daily during rest periods will never fully recover their vigilance decrement, and their ability to forage successfully and detect the presence of nearby predators will be degraded. Their ability to produce sounds used for communication and navigation may also be impaired.

?Scientists and conservationists have long worried that spinners? popularity with tourists ? and overlap of their resting habitats with popular ocean recreation destinations ? may be placing them at risk. Reports of interactions have increased sharply in recent years, but few published studies have examined the detrimental impacts these interruptions may have on the animals, especially at the population level.?

??It would be next to impossible to survey spinner populations and human activities in every bay that might be a resting habitat. We?re talking about hundreds of bays in the Hawaiian islands alone,? said Thorne.?

??Using predictive models, such as the maximum entropy spatial modeling approaches we?ve produced, is a much more cost-effective method,? she said. ?This type of modeling has only recently been applied to the study of marine mammals, but our work suggests it may be especially useful for studies (where data is) derived from opportunistic sightings and surveys using different types of research platforms.??

?The study was published August 27 in the online, peer-reviewed journal PLoS ONE.

Thorne and Johnston plan to test their models by conducting similar studies of spinner dolphin distributions and habitat use in the Northwestern Hawaiian Islands and elsewhere in the Pacific islands region. Results from those studies, they said, could confirm the new models? usefulness.

?Johnston and Thorne?s co-authors on the PLoS ONE study include Dean L. Urban, professor of landscape ecology at Duke?s Nicholas School, and Lars Bejder, associate professor at Murdoch University, Australia, and adjunct assistant professor at Duke.?

?The data on spinner dolphin sightings used to develop the models in the study were provided by a team of eight additional co-authors from Murdoch University, the Pacific Islands Photo-Identification Network, the Cascadia Research Collective, the Hawai?i Marine Mammal Consortium, the Hawai?i Association for Marine Education and Research, the Dolphin Institute, the University of Hawai?i (UH) at Hilo, UH at M?noa, and Marine Mammal Research Consultants.

GET FIT with Anytime Fitness of Spring Hill ? The Basics of Interval Training

Have you heard of interval training and wondered what all of the hype is about? What exactly is interval training anyway?

Simply stated, interval training combines short, high intensity activity with low intensity, recovery activity. Although many popular versions of interval training exist, they are derived from this basic formula. The main differences within individual programs are: the number and duration of intervals, the amount of rest time, and the types of activities incorporated. Because of the intense nature of these workouts, the duration of the sessions will be shorter than a typical steady-state aerobic workout, around 15 to 20 minutes or less.

A typical session will include a sufficient warm up and cool down, in addition to the key portion of the workout ? the intervals. Intervals can vary in length from 15 seconds to 3 or more minutes. The shorter the interval, the closer you?ll be to maximal effort. An example of a shorter interval might be 15 seconds hard with 15 to 60 seconds of rest directly following. On the other end of the spectrum, intervals that are 2 to 3 minutes will be less intense and lengthier in duration. An example of a longer interval might be 2 minutes hard followed by 2 to 4 minutes of rest.

When selecting a particular interval training program and work-to-rest ratios, be certain that they coincide with your current fitness level and your sports-specific goals. For instance, a sprinter may benefit from 15 second intervals; athletes participating in team-related sports like basketball or soccer from 30 to 60 second intervals; whereas the more extensive intervals are advantageous to distance runners and/or cyclists.

There are opposing opinions on the overall effectiveness, safety and benefits of interval training, in particular when weighed against the risks of incorporating vigorous exercise on a broad scale. There is consensus by most experts however, that proper interval training for an active population promotes improved respiratory and cardiovascular functioning, and aerobic and anaerobic capacities. In turn, as the body works more efficiently it is able to work harder and longer, ultimately improving performance and burning more calories and fat.

Interval workouts should only be performed 1 to 2 times a week, and should be varied every 3 or 4 weeks ? as you would with any routine to avoid adaption. As you progress, be sure to increase intensity, duration, or number of intervals, but not at the same time. If you aren?t happy with the work-to-rest ratios of a particular program, then change the intervals to ratios that work best for you. Interval training is vigorous exercise and should not be attempted by sedentary individuals or those with heart disease, high blood pressure or other serious health issues before speaking with a physician.

If you have only a radio, turning to a classical station, oldies station or whatever your favorite type of music is and settling down to read, study or just dream a little has always been a popular recreational activity. Teenagers have been listening to rock and roll on the radio for years, but even before that, old time radio shows were welcome entertainment for the entire family. Fibber McGee and Molly, Amos and Andy, The Lone Ranger and Gunsmoke are just few of the radio shows that families listened to together. There were also live music shows from some of the famous big band performances.

As television entered the entertainment mainstream,louboutin shoes, musical variety shows were often popular. Who could forget Ed Sullivan?s presentation of the Beatles first performance in the U.S. Other favorites included The Dinah Shore Show, Tennessee Ernie Ford and later,abercrombie, the Dean Martin Show and later Sonny and Cher, The Monkees and Donny and Marie Osmond.

The record companies were selling singles,ralph lauren, then records and the then long-playing stereo records. Stereos were becoming accepted as fine furniture, at the same time as upscale stereo systems became more and more common. It seemed at times that the music was less important than the equipment that it was played on. Then almost overnight it seemed, eight-track cassettes were available and people switched to the handy map pocket sized cases with the tape players built into the cars. The tape players had hardly made it into automobiles before CD players were optional equipment and then standard equipment in many vehicles.

At home, CD players were built into computers and the speed and quality of the discs improved exponentially over the next few months. At the same time as the media forms were changing from records to CDs, many musical instruments sound was created electronically on electronic keyboards. These instruments had a piano like keyboard but added chords, rhythms and embellishments to a one finger melody. There are even prerecorded pieces that can be played.

Today, many people listen to music on headphones from an MP3 player or even to music pieces downloaded to their cell phones. Sharing musical ring tones, or musical pieces by their favorite artist with friends is a common way to spend an evening. At the same time as music carrying capacity jams more music into a smaller disk or memory card, televisions screens are getting larger and larger. In fact, you can listen to dozens of music stations sorted by genre on your television set billed as a home theater experience.

Today there are not many high class stereo systems including a radio, record player,abercrombie et fitch, and cassette player around. A mobile phone unit can pull in FM radio stations,Louboutin, play memory cards with dozens of songs per memory card in one small package, not much larger than a candy bar. By using a headphone or Bluetooth technology, each listener can be lost in a completely different kind of musical enjoyment.

Israel army chief warns those who think can 'eradicate' Israel

Israeli army chief, Lieutenant General Benny Gantz, warned on Wednesday that those who believed they can "eradicate" Israel will face the brunt of Israeli power, in a veiled threat to Iran.

"These days, the state of Israel and its residents are being threatened. These threats indicate a mistaken evaluation of our strength and capabilities," he said at a ceremony in memory of fallen soldiers.

"Those who believe they can eradicate Israel and act on these beliefs will face the brunt of the IDF power," he added, according to a military statement.

Gantz said the Israeli army was ready and "prepared along our country's borders" to thwart any such threats.

Gantz's remarks come just days after Iran's supreme leader Ayatollah Ali Khamenei said that the "cancerous tumour" of Israel is the biggest problem confronting Muslim countries today.

In a speech marking Eid al-Fitr, the end of the Muslim holy month of Ramadan, Khamenei said "the big powers have dominated the destiny of the Islamic countries for years and... installed the Zionist cancerous tumour in the heart of the Islamic world," according to Iran's official IRNA news agency.

"Many of the Islamic world's problems come from the existence of the sham Zionist regime," he was quoted as saying.

And last week Iranian President Mahmoud Ahmadinejad also told an annual anti-Israel protest in Tehran that the Jewish state was a "cancerous tumour" that will soon be excised, drawing Western rebukes.

"The Zionist regime and the Zionists are a cancerous tumour," he said.

"The nations of the region will soon finish off the usurper Zionists in the Palestinian land.... A new Middle East will definitely be formed. With the grace of God and help of the nations, in the new Middle East there will be no trace of the Americans and Zionists," Ahmadinejad said.

Khamenei and Ahmadinejad have long used the word "tumour" to portray Israel as an illegitimate state in the Middle East that will inevitably disappear.

There expressions have often met with condemnation from world leaders.

Tensions between Israel and Iran are taut because of threats by the Jewish state to attack nuclear facilities in the Islamic republic to prevent it reaching the capability to produce nuclear weapons.

Israel and its ally, the United States, accuse Iran of seeking to develop an atomic arsenal.

Tehran denies that, and says its nuclear programme is exclusively peaceful. Its military chiefs warn they will destroy Israel if it attacks.

Mars Rover Curiosity to Take 1st Martian Drive Wednesday

After more than two weeks of sitting still, NASA's Mars rover Curiosity is finally set to roll out on the Red Planet with its debut drive on Wednesday (Aug. 22).

Engineers successfully tested the rover's steering abilities yesterday (Aug. 20), and now they're ready to turn its six wheels for the first time since Curiosity landed on Mars?on Aug. 5, officials announced today.

"Everything's in fine shape, and that means we are 'go' for our first test drive tomorrow," Curiosity mission manager Mike Watkins, of NASA's Jet Propulsion Laboratory (JPL) in Pasadena, Calif., told reporters today.

Curiosity's first drive on Mars will be a short one. The rover will move about 10 feet (3 meters) forward, turn in place to the right, and then back up a few meters. The whole operation should take the rover about 30 minutes, Watkins said. [Latest Mars Photos by Curiosity Rover]

Taking it slow

The 1-ton Curiosity rover is the heart of NASA's Mars Science Laboratory mission (MSL), which seeks to determine if the Red Planet could ever have hosted microbial life. The rover is exploring a huge crater called Gale that's about 96 miles wide?(154 kilometers) .

Curiosity's main target is the base of Mount Sharp, the 3.4-mile-high (5.5 km) mountain rising from Gale Crater's center. Mount Sharp's foothills appear to bear clays and sulfates, suggesting the area was exposed to liquid water long ago.

But the rover's first big set of drives will take it away from its ultimate destination, toward a spot mission scientists have dubbed Glenelg. Glenelg, which is about 1,300 feet (400 m) from Curiosity's landing site, hosts three different geological formations that mission scientists are eager to investigate.

If all goes well with tomorrow's driving test and a few other checkouts, Watkins said, Curiosity could start heading for Glenelg around Sol 20 or so ? mission lingo for its 20th full day on Mars. That corresponds roughly to Saturday (Aug. 25), since Sol 16 begins this evening.

The mission team eventually wants Curiosity to cover about 330 feet (100 m) or more of Martian ground in a big driving day, but that probably won't happen for a while.

"It's going to take us a little while to get up to that rate," Watkins said. "This first set of drives ? not just the test drive tomorrow but actually the drive to Glenelg ? we'll probably do that in pretty small chunks, just to evaluate, you know, what's going on and take a look at the processing algorithms. My guess is that those are going to go in 10- to 20-meter chunks."

In good shape

Researchers have been checking out Curiosity and its 10 science instruments since the rover landed, ensuring that it's ready for its two-year surface mission.

By and large, the checkouts have been going extremely well, team members have said. On Sunday (Aug. 19), for example, engineers deployed Curiosity's 7-foot-long (2.1 m) robotic arm for the first time and did motor checks on its many tools, which include a percussive drill and soil-scooping gear.

"All of that went successfully as well," Watkins said.

And on Friday (Aug. 17), Curiosity used its Dynamic Albedo of Neutrons (DAN) instrument for the first time on Mars. DAN measures the amount of hydrogen ? an indicator of water ? in the Martian soil by peppering the ground with neutrons and then observing the extent to which they scatter back.

Curiosity's ChemCam instrument ? which fires a laser at rocks and then determines their composition by analyzing the vaporized bits ? also got its first workout over the weekend. It's performing even better than anticipated, researchers said.

Curiosity's onboard weather station, which is called REMS (short for Rover Environmental Monitoring Station), has been switched on. From Aug. 16 to Aug. 17, it measured ground temperatures as high as 37 degrees Fahrenheit (3 degrees Celsius) and as low as minus 131.8 degrees Fahrenheit (minus 91 degrees Celsius).

However, REMS is not working perfectly on the Martian surface. Wind sensors on one of the instruments' two booms have been damaged, perhaps by rocks deposited on Curiosity's deck during or shortly after landing, researchers said.

But wind sensors on the other boom are working fine, so the team doesn't anticipate too much of an impact.

"We still retain nearly the full capability, just with a little bit of ambiguity in terms of wind direction," said MSL deputy project scientist Ashwin Vasavada of JPL.

A look at recent tech-industry earnings

This week, Dell and Hewlett-Packard will report quarterly earnings. They will offer a peek into whether global economic worries have affected their sales, as they have with some other tech companies.

Here is a summary of recent earnings and reports for selected technology companies and what they reveal about the state of spending and the overall economy:

? July 2: Microsoft Corp. says it is absorbing a $6.2 billion charge to reflect that one of the biggest deals in its 37-year history, for online ad company aQuantive, turned out to be a dud.

? July 6: Samsung Electronics Co. estimates its second-quarter operating profit at 6.5 trillion won to 6.9 trillion won ($5.7 billion to $6.1 billion), a 79 percent jump from a year earlier based on the midpoint of that range. Analysts say the sharp rise in operating profit was driven by the success of its Galaxy line of smartphones. However, Samsung's stock fell as lower-than-expected overall sales underlined the threat from Europe's economic malaise.

? July 9: Chipmaker Advanced Micro Devices Inc. lowers its quarterly forecast, blaming weaker-than-expected sales in China and Europe and lackluster demand overall from consumers. AMD says it expects revenue to fall by 11 percent from the previous quarter, below its earlier forecast of a 3 percent decline.

? July 10: BlackBerry maker Research in Motion Ltd. asks disgruntled investors at a shareholders meeting for patience as it develops new devices to rival the iPhone and Android smartphones. The company reiterates a warning that the next several quarters will be challenging. It also expects to book another operating loss in the current quarter as the company cuts prices to sell its older BlackBerry models.

? July 17: Yahoo Inc. reports another lackluster quarter on CEO Marissa Mayer's first day on the job. It continues years of financial lethargy that has plagued the one-time Internet pioneer as Google and Facebook have prospered. Net income fell 4 percent from a year ago, and adjusted earnings were short of expectations.

Intel Corp., the world's largest chipmaker, says revenue for the current quarter is likely to come in below Wall Street forecasts as it blames "a more challenging macroeconomic environment."

? July 18: IBM Corp. reports its 38th consecutive quarter of earnings increase. Net income rose 6 percent despite a 3 percent drop in revenue amid Europe's economic jitters. IBM revenue in Europe, the Middle East and Africa fell by 9 percent from last year. The turmoil in Europe hurt IBM's results as currencies there weakened, translating into fewer U.S. dollars. IBM says revenue would have been slightly higher than last year if currency-exchange rates had remained the same.

EBay Inc. more than doubled its second-quarter net income thanks to higher revenue from its PayPal online payments business and its e-commerce websites. Its marketplaces business, which includes its flagship website, saw the strongest growth rate since 2006.

? July 19: Google Inc. says its second-quarter earnings rose 11 percent despite a deepening decline in the prices paid for its Internet search advertising. The results included Google's $12.5 billion acquisition of cellphone maker Motorola Mobility Holdings Inc. for the first time. Revenue climbed 35 percent from last year to $12.2 billion. If not for Motorola, revenue would have increased by 21 percent.

Microsoft Corp. says a $6.2 billion accounting adjustment to reflect a weak online ad business led to its first quarterly loss in its 26 years as a public company. The company had a loss of 6 cents a share, compared with earnings of 69 cents a share a year ago. Adjusted earnings beat expectations, and the stock rose.

Verizon Communications Inc. says net income rose 13 percent in the second quarter as its wireless arm pulled in record profits. But its traditional, wired phone business was weaker. Like other phone companies, Verizon is losing landlines, but has been compensating to some extent by signing up broadband customers. In the second quarter, that trend faltered, as it gained just 2,000 broadband customers ? the worst result in four years.

? July 24: Apple Inc. reveals that its growth slowed in the most recent quarter. In both revenue and net income, the company posted the smallest increases in years and failed to meet analyst expectations. It wasn't so much the volume of sales, but Apple's average selling prices declined.

At AT&T Inc., meanwhile, declining smartphone sales contributed to the best profitability ever in its wireless arm as it saved on phone subsidies. AT&T says it activated fewer smartphones in the quarter, much of it because subscribers are holding to their phones longer. That's good news for the company because it doesn't have to shell out as much in subsidies to sell the phones to customers for $99 or $199.

Netflix Inc. reports a 91 percent reduction in second-quarter earnings amid a slowdown in subscriber growth. Netflix Inc. added 1.1 million worldwide subscribers to its streaming service ? in line with management predictions, but below what analysts had hoped for.

? July 25: Online game maker Zynga Inc. reports a loss in the second quarter, with adjusted earnings and revenue below Wall Street's already low expectations. Zynga also lowers its outlook for the year, citing game delays, reduced expectations for "Draw Something" and what it called a "more challenging environment on the Facebook Web platform." Changes Facebook made to its website can make older games such as "FarmVille" more difficult to discover.

? July 26: Facebook Inc.'s first earnings report as a public company had solid numbers, but in the end it landed with a thud ? much like its rocky initial public offering two months earlier. Facebook reported stronger-than-expected revenue and a gain in user numbers, but investors weren't impressed. After a brief spike, its stock fell.

Sprint Nextel Corp., the country's third-largest wireless carrier, reports a wider loss for the second quarter as wrote down the value of its moribund Nextel network. However, Sprint was successful in persuading smartphone subscribers to pay up for "unlimited data" service, and its service revenue zoomed, beating estimates.

Online retailer Amazon.com Inc. reports earnings that matched Wall Street's meager expectations, but its revenue gains and outlook for the current quarter fell short of forecasts.

? July 27: Samsung Electronics Co. reports another record-high quarterly profit as customers flocked to Galaxy smartphones. Samsung benefited from runaway demand for its Android-powered smartphones as rivals including Apple Inc. had yet to release new models. Robust sales of smartphones helped offset a slowdown in other consumer electronics businesses such as televisions.

? Aug. 1: Comcast Corp. says strong results from cable operations overcame weak returns from the box-office flop "Battleship" at its Universal Pictures studio. Net income and revenue increased. In cable, average monthly fees were up 8 percent from last year to $148.57, helped by customers upgrading to faster broadband speeds and getting more premium channels. Overall, cable revenue grew 6 percent, demonstrating that Comcast continues to do better than smaller cable companies.

? Aug. 2: LinkedIn Corp. says net income fell as it spent more money to grow its business. But the professional networking site saw revenue grow faster than expected and raised its forecast for the year.

Sony Corp. says its loss worsened in the April-June quarter and it lowered earnings forecast for the fiscal year through March as it battles a strong yen and declining sales of liquid crystal display TVs and video game machines. Sales increased 1.4 percent, helped by cameras, professional broadcasting products and mobile phones.

? Aug. 8: Hewlett-Packard Co. says it will take a massive charge against its earnings for the quarter through July, leading to a record loss of nearly $9 billion. The charge is the result of a writedown of the value of its services business, reflecting that the company overpaid for its purchase of Electronic Data Systems in 2008.

? Aug. 13: Online deals site Groupon Inc. says the weak European economy contributed to lower sales growth than expected, while analysts express concern that the company is increasing revenue through the less-profitable business of actually selling items, rather just directing customers to great deals. Although Groupon beat Wall Street's profit estimates in the latest quarter, investors focused on the dual concerns about growth.

? Aug. 15: Cisco Systems Inc. reports earnings that show its ambitions cramped by the global economic turmoil, but results for its latest quarter were strong enough that it announced an increase to its dividend. Cisco's sales in the latest quarter rose just 4.4 percent, as customers in Southern Europe were in the grips of a recession and government customers on both sides of the Atlantic held back.

What Makes Literature Great? The Readers!

That is not great literature written by a great author. It is a Little Willie rhyme written by me. There are thousands of these and I loved them as a kid. They are not attributed to any author that I know of. Every body and his dog has written one but now they appear in tomes such as 10,000 Old Jokes You Never Heard Of.

Such is not great literature except to an old man likes me who likes to go back and read what he liked as a kid like, I Was a Headhunter and Jimmy Microbe.

Much of what is great literature is tedious to read or down right boring to most people. Such literature is called the Classics. The Bible is considered great literature, which is what it is, but all in the Bible is not like the Book of Ruth, Job, or the Gospel of John, or even the Book of Acts. Some is horribly repetitious and downright boring.

The Revelation, perhaps taken from three early tracts (much taken from Daniel), is not understood by many people, even some of those who think they understand it. Is it a classic or just a curiosity?

Maybe one definition of a Classic could be that your English teacher made you read it. Tolstoy and Homer and Shakespeare and other such great writers could be on your list. Poe is another winner.

I remember as a kid we were told to read the Lance of Kanana by Harry W. French where a boy shepherd wins his father's respect by recovering a stolen caravan. I read every word of my literature book but I could not stomach the boredom of that story. The teacher loved it.

I hear students suffering all the time because of some book assignment. They put it off to the end and finally go to the Internet to see if they can grab enough stuff to write a report while they burn the midnight oil.

If the book were worth their reading, they would be much more eager to read it. It is the teachers job to inspire their students to read and just passing out a required reading list is not enough. I had teacher once in junior high school who read to us most days. We loved to have her read to us and we learned to love the good stuff she was reading.

Some think that you have to get used to great literature, especially the classics. Some suffer through it long enough to write an M.S. or Ph.D. thesis writing about what someone else wrote instead of writing their own original stuff. They become teachers and make you read the stuff you hate.

I once had an assignment in a speed reading course to outline a book. I was no kid. I had just come back from fighting a war where I was a 19-year-old infantry platoon sergeant and I didn?t need a stupid assignment. I just grabbed a book with a detailed table of contents and submitted that. I think it was about John Fremont?s explorations of the West. Maybe the instructor thought with all our fast reading ability we could get a job outlining books.

Now days I hear parents complain about reading assignments like Lady Chatterley's Lover, a novel by D. H. Lawrence who has her ladyship, wife of an invalid, drift into the shack of the estate game keeper who puts flowers on her bare belly.

It seems that parents have read every controversial book in existence and they say, ?I don?t want my kid reading that trash. Let?s go down to the library and rip it off the shelf and burn it in the street.?

Book burning is a great past time of dictators.

My definition of great literature is that it is the stuff that makes the best seller list because it has been accepted by a large group of readers. I know you can say that the Sunday comics and Parade Magazine is great literature. You can also say that what I?m calling great literature is next years trash and will not be called classical.

How true.

Hemingway was great because he was an artist with words that read like paint, a perfectionist with great stories to tell. Ole!

Jack London was like Hemingway or rather, vice versus, with great adventure stories. You could hear ship timbers creaking or feel your feet freezing.

Robert Lewis Stevenson was great because he appealed to children with his adventures. (He died, never being well one day of his life, but he said that if the never got out of bed because he was sick, nothing would be accomplished. He is one of my heros.)

Steven King is great because he tells a good yarn and delves where others don?t go. But I personally think that the Shawshank Redemption was his greatest novel, although short, and the movie was a perfect portrayal of the novel. His writing is excellent but I don?t always dig his stories.

J. R. R. Tolkien?s The Lord of the Rings is read far and wide. I don?t like that kind of stuff myself but about everybody I know does.

Tom Clancy is a prolific writer who likes to write about he CIA and the military. He gets technical but sometimes overly simplifies things for we tech types. Publishers hire committees to help writers put out more stuff. That may be what they are doing with Clancy. James A. Michener wrote a lot of good stuff in his early days before we were bombarded with historical fiction with the staff digging up information by the ton. These fat-book writers lose my interest as soon as the publisher moves in to push for quantity.

J. K. Rowling, a woman with a man?s name demanded by her publisher, wrote at least seven Harry Potter novels. I can?t stand them myself but they are loved by young and old. She is now writing mystery novels and her first one will soon be out.

Stephenie Meyer?s Twilight Series which my wife?s care giver?s son said is about kids killing kids. That is what he said. He says it is very well-written. His mother says it is futuristic SciFi. Not for me but fodder for many.

Writers write, readers read. Each does as they please. To me, if the story is not my cup of tea, then no matter how good the actual writing is, I?m just not reading it. The writer must tell me what is going on in the first couple of pages or I?m gone.

When I wrote a novel about Nazis in America, I didn?t know exactly what the story was. I read the first draft and chucked it into the garbage can, not relying on it a reference. I knew the story and I just sat down and rewrote the book.

My point is that if there is no compelling story, forget it. Dump it!

I did just that when I wrote a novel years ago. I wrote seven boring chapters and dumped it because the story was not there.

I don?t write long stuff any more, just crummy articles like this. I have to write and that is it. But I miss the characters bugging me to let them take over the book. When I wrote a western saga, one character was so strong, I had to downplay him to make sure the action was focused on my protagonist. I wrote a new novel starring this character.

I would tell you the names of those books but the editors here would reject the article because of self aggrandizement. I said that I no longer write novels. I?m 80-years-old. I?m not building a career.

The book market has changed, many folks having moved to ebooks which are convenient and less expensive. Authors have a tough time promoting their books. Celebrities have ghost writers write their books and ten they call Leno and Letterman and other talk show host and get their books on the best seller list.

But there are those special writers who have people standing in line to get their next book. One successful book can put a writer in an enviable seat. Meanwhile, we can make our selection and enjoy the word of literature.

Little Willie found a story,

Of a knight and all his glory.

And even though he could not read.

He used the broomstick as his steed.

Note: There are thousands of wonderful books that have never been published. Publisher can only publish so many books each year and they know what type of book they are going to publish before they ever receive a manuscript from a writer.

Stewart's role uncertain in 'Snow White' plans

NEW YORK (AP) ? Universal Pictures is continuing to pursue a sequel to "Snow White and the Huntsman" in the wake of Kristen Stewart's affair with the film's director.

Universal co-chairman Donna Langley said in a statement Wednesday that the studio is "currently exploring all options to continue the franchise" and that reports of Stewart's exit "are false."

A beleaguered Stewart got a public defense Wednesday by Academy Award-winner Jodie Foster, who co-starred with a then-11-year-old Stewart in the 2001 move "Panic Room."

Foster wrote an essay for The Daily Beast in which she blasted the "gladiator sport of celebrity culture" and claimed that if she were a young actor today she would quit before she started.

"If I had to grow up in this media culture, I don't think I could survive it emotionally," she writes. Of life as a target of paparazzi and criticism, she added: "We seldom consider the childhoods we unknowingly destroy in the process."

Since Stewart, who played Snow White in "Snow White and the Huntsman," and Rupert Sanders, its married, 41-year-old director publically apologized for a tryst caught in photographs, the future of "Snow White" has been uncertain.

The film was intended to launch a franchise, and its worldwide gross of $389.3 million was a promising enough start.

The Hollywood Reporter reported Tuesday that Universal was shifting the sequel to focus on the Huntsman character, played by Chris Hemsworth. The report claimed that Stewart was being dropped.

Universal declined to comment further on its plans.

Mothers Initiate Breast Feeding with the Help of the Nurse Family

The Nurse Family Partnership recently achieved a great accomplishment, with 75.3 percent of their mothers initiating breast feeding. This is in line with the US Surgeon General?s goal of having 75 percent of all mothers initiate breast feeding. ??

The Nurse-Family Partnership (NFP) is a nationally recognized early childhood nurse home visiting program for first time, low income mothers and their child until two years of age.? In 2011, NFP has cited as the only home visit program to have produced important improvements in the lives of at-risk children and parents by the Coalition for Evidence-Based Policy.

Lutheran Children and Family Service is the largest clinical site sub-contractor and serves 200 eligible families. Through regularly scheduled home visits, eight LCFS public health nurses offer high-risk adolescent and adult women a rich curriculum and resource support that leads to successful parenting.? The program goals are to improve pregnancy outcomes and child development, and also to improve families? self-sufficiency.? Consistent program findings are improved prenatal health, fewer childhood injuries, fewer subsequent pregnancies, increased intervals between births, increased maternal employment, improved school readiness, and less involvement with the juvenile and adult justice systems.? The average age of Philadelphia NFP clients is between 17 ? 18 years of age with 60% enrolled under 20 years of age.

Mary Beth Haas, the Nurse Family Partnership Program Manager for LCFS says that breast feeding is finally getting much needed national recognition. ?It?s being talked about more as a health issue now, not just a feeding choice,? she said.

?We?ve recognized for a long time that there are benefits for the baby, but now research has found that there are significant benefits for the mother as well,? Mary Beth said. Studies show breastfeeding decreases the mother?s risk of breast cancer, ovarian cancer and endometrial cancer.? Breastfed babies receive over 101 benefits with a higher IQ, less allergies, a decrease in asthma, and? protection ?against digestive diseases such as Chrohn?s Disease to name a few.

Blair Lamb, a Public Health Nurse for the Nurse Family Partnership, encourages her clients to try breast feeding by educating and preparing them, well before the baby is born. ?A lot of the mothers don?t know about the benefits of breast feeding, and formula is so readily available,? Blair said. ?Sometimes they?re scared that it?s going to hurt, or are embarrassed to breast feed in public.? Blair addresses her clients? concerns, and guides them on what to expect. ?The first couple of days are challenging, I help my client to understand and accept those challenges,? she said. ?It?s really rewarding to help someone do something that is good for themselves and their baby.?
