Torture memo author John Yoo and others who have called for Boston marathon bombing suspect?Dzhokhar Tsarnaev to be held in military detention are claiming vindication following reports that Tsarnaev stopped talking to interrogators after a judge advised him of his right to remain silent.
"Apparently the FBI interrogated the younger Tsarnaev for 16 hours," wrote torture memo author John Yoo at National Review. "And then, for reasons that are still unknown, the government read him his rights."
Yoo has never met a right he didn't want to ball up like a piece of paper and toss into a trash can in the name of national security. But despite being an attorney and professor at the prestigious University of California Berkeley School of Law, Yoo is either misleading his readers about why Tsarnaev was read his rights or unaware of a basic legal rule.
The judge appeared at the hospital because the Federal Rules of Criminal Procedure state that suspects have to be brought before "a magistrate judge, or before a state or local judicial officer" and it must be done "without unnecessary delay." The Supreme Court has held that, absent exigent circumstances or the suspect waiving the right to go before a judge?as wannabe Times Square bomber Faisal Shahzad reportedly did?a suspect has to appear before a judge within 48 hours of being apprehended. This is usually referred to in legal shorthand as "presentment," as in, "presentment before a judge."
"In practice, this means that law enforcement officers usually have no more than 48 hours to interrogate suspects without [informing them of their rights], and usually far less," explains Steve Vladeck, a law professor at American University School of Law. "Once presentment occurs, the judge, if not the interrogating officers, will advise the suspect of all of his rights."
That's what happened in this case. Tsarnaev's interrogators didn't read him his rights. Nor did the "Obama administration," as some, including Sen. Dan Coats (R-Ind.), have claimed. A judge did it. The 48-hour rule exists to prevent the government from detaining people secretly and without a suspect knowing the charges against them. Needing to interrogate a suspect is not included in the exigent circumstances that can be used to justify delaying bringing the suspect before a judge. And the government could not have legally placed Tsarnaev in military detention, either, because absent evidence of concrete operational connections between Tsarnaev and Al Qaeda or its affiliates it would not be legal to do so?and it might not be constitutional even if it were technically legal.
"This is a rule of law issue, and it's also an effectiveness issue," says Hina Shamsi, an attorney with the ACLU. "Calls to do an end-run around constitutional rights are not just wrong they prevent a fair and effective prosecution."
The feds have every reason to play this one by the book. Few things could compound the tragedy of Boston like jeopardizing Tsarnaev's prosecution because of a rush to trample his constitutional rights.

Longtime Apple board member Bill Campbell gave a talk at Intuit, where he once served as CEO and currently serves as chairman of the board, about the future of technology and how it will likely become more intimate with everything from Google Glass to Apple initiatives he wasn't at liberty to discuss (but fill in your own iWatch, at least short term). According to Ashlee Vance of Businessweek:
The conversation started with a look ahead toward future products. Noting that he was not at liberty to give away specific details on future Apple gizmos, Campbell did tell the audience to expect to see ?a lot of things going on with the application of technology to really intimate things.? He pointed to Google Glass as one such intimate object. ?It?s a phenomenal breakthrough,? he said. ?When you start to think about glasses or watches, they become as intimate as the cell phone was.?
Technology is absolutely becoming more personal and more intimate. (No, not that kind of intimate, though that kind of intimate will no doubt be a subsection of the greater movement.) Huge room-filling mainframes became large, desk-filling personal computers are becoming small lap or hand filling tablets and phones will one day become tiny wrist or collar filling watches or broaches will one day become nearly invisible parts of us. It's terrifyingly exciting, as only the future can be.

MOSCOW (AP) ? Russia on Saturday banned 18 Americans from entering the country in response to Washington imposing sanctions on 18 Russians for alleged human rights violations.
The list released by the Foreign Ministry includes John Yoo, a former U.S. Justice Department official who wrote legal memos authorizing harsh interrogation techniques; David Addington, the chief of staff for former U.S. Vice President Dick Cheney; and two former commanders of the Guantanamo Bay detention center: retired Maj. Gen. Geoffrey Miller and Adm. Jeffrey Harbeson.
The move came a day after the U.S. announced its sanctions under the Magnitsky Law, named for Russian lawyer Sergei Magnitsky, who was arrested in 2008 for tax evasion after accusing Russian police officials of stealing $230 million in tax rebates. He died in prison the next year, allegedly after being beaten and denied medical treatment.
The U.S. State Department released a statement Saturday in response to Russia's latest decision.
"As we've said many times before, the right response by Russia to the international outcry over Sergey Magnitsky's death would be to conduct a proper investigation and hold those responsible for his death accountable, rather than engage in tit-for-tat retaliation," according to the statement.
Neither Washington nor Moscow put high-ranking or politically prominent figures on their lists, perhaps aiming to limit the effect on U.S.-Russian relations that have deteriorated, despite President Barack Obama's initiative to "reset" relations with Moscow.
The Magnitsky law infuriated Russian authorities, and parliament quickly passed a retaliatory measure than banned Americans from adopting Russian children. Russia also has banned U.S. funding for any non-governmental organization deemed to be engaging in politics.
"I think that both sides showed a definite restraint because in Washington and in Moscow there were hotheads demanding to inflate the list to an unthinkable size," parliament member Vyacheslav Nikonov, who focuses on foreign affairs, was quoted as saying by the news agency Interfax.
The ITAR-Tass news agency quoted Deputy Foreign Minister Sergei Ryabkov as saying there also is a "closed part" of the list of banned Americans and that the U.S. knows of its existence. The U.S. law in turn allows the administration to compile a separate classified list of Russian officials subject to visa bans.
The public U.S. list includes Artem Kuznetsov and Pavel Karpov, two Russian Interior Ministry officers who put Magnitsky behind bars after he accused them of stealing $230 million from the state. Two tax officials the lawyer accused of approving the fraudulent tax refunds, and several other Interior Ministry officials accused of persecuting Magnitsky, also were on the list. Absent were senior officials from Russian President Vladimir Putin's entourage whom some human rights advocates had hoped to see sanctioned.
Foreign Ministry spokesman Alexander Lukashevich said in a statement Saturday that the U.S. sanctions struck "a strong blow to bilateral relations and joint trust."
Also on Russia's list are 14 Americans whom Russia says violated the rights of Russians abroad. It does not give specifics of the alleged violations, but includes several current or former federal prosecutors in the case of Viktor Bout, the Russian arms merchant sentenced in 2012 to 25 years in prison for selling weapons to a U.S.-designated foreign terrorist group.
A federal judge, one FBI agent and four U.S. Drug Enforcement Administration agents also are on the list. Some of them were involved in the case of Konstantin Yaroshenko, a Russian pilot convicted for drug smuggling.
"It's important that the criteria on which the Russian list was composed differ fundamentally from the Americans'. On the Russian list, including the closed part, are people actually responsible for the legalization of torture and indefinite detention of prisoners in Guantanamo, for arrests and unjust sentences for our countrymen," Ryabkov was quoted as saying.

It was the Afternoons program on 774 ABC Melbourne that got me thinking about my gardening pedigree.? Presenter Richard Stubbs asked listeners how they came to take up gardening.? Was it passed on from someone else?
I grew up in a gardener?s house and remember constant talk of? Spring and Autumn annuals, Marigolds, Petunias, Camellias, Dahlias, the constant moving of sprinklers and manure.
When Nana came to live with us in the late 1970s, the garden talk doubled and if my Great Auntie Rosie came to visit, well.? Auntie Rosie was Nana?s sister and they had other siblings that were keen gardeners too.
One was my great-uncle Bill Hadden.? Visiting his garden was special.? I remember fish ponds, orchids and a large television antenna tower that I had an urge to climb every time I went there.
This is a lovely photo of Uncle Bill as young man in his parent?s backyard at 78 Coleraine Road, Hamilton, planting seed in neat rows with help from his niece, Margaret.? It was about 1934.
I too lived at 78 Coleraine Road.? Mum and Dad lived there when they first arrived in Hamilton after their marriage in 1967.? I came along in March 1968 and we lived there for about a year after my birth.? I wish I had have been older to remember the house, which was later pulled down, as that was the family home of my great grandparents, Thomas Hadden and Sarah Harman and where Nana and her brothers and sisters grew up.? Four generations lived in that house.
I showed Mum the photo of the backyard at 78 Coleraine Road and she was able to tell me more about it.? She said there was still a fence across the backyard when we there but it is was then made from? chook wire.?? Auntie Rosie had lived there before us and she kept chooks.? After the photo, cherry plum and blood plum trees were planted and an apple tree, seen in the photo, was still there 33 years later.
Uncle Bill had his own home built after returning from WW2.? It was at 80 Coleraine Road, next door to his parents.
The photo above, shows Mum and Nana, on the left, and Mum?s cousin Norma, right, in the front yard of Uncle Bill and Auntie Bess.? Although a reasonably new house, Uncle Bill already had an established garden and neat concrete and lawn driveway.? He later added a garage and sheds at the end of the driveway.
Alma, another of Nana?s sisters was also a green thumb.? When I visited her a few years ago, when she was in her late 90s, I was amazed at her beautiful potted cyclamen on her back porch. Despite almost no vision, she tended them with care.? She was often found pottering around the garden that she knew so well and was able to move around nimbly.

Before Nana came to live with us, she and my grandfather, Bill Gamble lived in Ballarat and I have great memories of visiting their house.? The backyard was small but? the space was well used .? Bill grew espalier apples, among other things, and had a shed with three sections lining the back fence.? From my memory, the left section was a fernery, the middle a utility shed that held grain to feed the occupants in the third section, the chooks.? I did like to admire the maiden hair ferns and their cool, soft foliage,? and the feed shed where I dipped my hands into oats in a large wooden barrel. But I did not go in the chook shed.
When I checked my memory against mum?s she told me the left side of the shed was interchangeable, depending on her father?s interest at the time.? He used to have budgies too and I can now remember budgie boxes in that part of the shed and attached to the fence.? She couldn?t remember the maiden hair ferns, but her father did grow Pelargoniums at one point.? That must have run in the family, as the following is a photo of one of Mum?s Pelargoniums.
The next photo was taken looking across the Gamble backyard.? We have several photos taken from this angle.? It must have been the ?photo spot?.? Nana (centre) is? flanked by Bill?s aunt, Jane Diwell and a friend of Jane?s from Geelong.? In the front is my Uncle Peter.? Hopefully the photo shoot did not go on too long as there may have been an accident.
Of interest here is the espalier apple tree on the fence, the concrete garden edging my grandfather put in himself, the sack of oats and the Bergenia or ?Elephant?s Ears? along the toilet wall.? Mum? used to call them ?toilet flowers?.
Auntie Shirley, Bill?s sister is also a keen gardener.? We visited her in the past year and her garden was beautiful, a result of much hard work on her part.? She is now in her 80s.
My grandfather, Auntie Shirl and Auntie Jane were descended from a keen gardener, Richard Diwell, Jane?s father.? Richard was a member of the Hamilton Horticulture Society. His specialty was chrysanthemums.? The society often attended shows in nearby towns and the following? item is from 1896 when the Hamilton growers headed to Portland to show of their blooms.? Richard won three prizes in his class.
The chrysanthemums exhibited by the Hamilton growers were impressive, some a little too impressive for an amateur show.
Richard also liked ferns and apparently had a fernery.? He was a keen photographer too, and this is one of the photos we have that he ?staged? and took himself with a camera timer.? A selection of plants are in the foreground including a maidenhair fern.

A garden photo that interests me is from the backyard of Richard?s daughter, Edith Diwell, my great-grandmother.? The photo is of three of her sons, including Grandfather Bill on the left.? This was either at a house in Mt Napier Road, Hamilton or Skene Street, Hamilton.? Either way, they would have only been in the house a short time before the photo was taken, so the garden layout was not the work of Edith.? However, it still gives an example of a 1920s backyard.? There is a vegetable garden, with wooden edging and the boys are standing in front of a Yucca.? A fruit tree stands in the background.
My paternal side of the family, the Riddifords, did not have the same influence on my love of gardening.? Dad has never grown anything.? Well, at least that?s what I thought.? Mum told me how he thought cauliflowers could be a profitable venture, sometime around 1967, and planted them in the backyard at 78 Coleraine Road.? Turns out there was little market for his produce and that was the end of his gardening days.? We probably ate cauliflower with white sauce for some time afterwards.
Dad?s father, Percy Riddiford, did like to garden.? It was not until? recent years that I came to know how much.
Prior to her death, my Grandma, Mavis, gave me a binder of Your Garden magazines collected by Grandpa.? I knew he liked roses as they lined the perimeter of their front yard, but I didn?t realise his passion went as far as buying gardening magazines.? It just happened that the year the magazines were from was 1968, the year I was born.
I did enjoy visiting Grandma and Grandpa?s in Ballarat.? A sign, ?The Riddifords? hung proudly on the letterbox. ? A terrace garden was at the back of the steep block.? Three large steps led to the top of the terrace and I recall that as a small child, I would haul myself up the steps and teeter on the top to look across neighbouring backyards to see Sovereign Hill in its infancy, sprouting up on a nearby hill.? I would cry out that I could see the ?historical park?.
I recently drove past Grandma and Grandpa?s old house to see if Grandpa?s roses were still there.? I do remember them there, but look old and gnarly, not the many years ago.? They are now gone, but suckers grow were the roses were.? A little reminder of Grandpa.
?My gardening history started in a rented house, but now with a? home of my own, more passion is imparted.? In the 13 years we have lived here, I have gardened through a 10 year drought, dogs, goats, child and recently a plant shredding hail storm.? Inspired by Edna Walling and dispirited by Mother Nature and her creatures.
My garden is probably not at the point I would like it, but it has changed over the years thanks, I suppose, to the drought.? I started with a range of cottage perennials, including some unusual varieties, but full water restrictions (no mains watering) did not help many of those thirsty English plants.? Anything that survived I have planted more of, and more natives and succulents have come in.
One of my favourite plants is the Aquilegia or ?Granny Bonnet?.? It was also a favourite of Nana?s.
One day my ?Zephirine Drouhin?? roses will cover the arch they grow beside.? But every year, just as the juicy new shoots show, two white creatures manage to break into my garden and indulge in one of their favourite delicacies.

NEW YORK (AP) ? Stocks are mixed in early trading on Wall Street as traders gear up for the beginning of corporate earnings reports.
The Dow Jones industrial average was off 23 points, or 0.2 percent, at 14,541 shortly after the opening bell Monday.
The Standard & Poor's 500 index was down less than a point, or 0.04 percent, at 1,552. The Nasdaq composite rose five points, or 0.1 percent, to 3,208.
Investors are turning their attention to U.S. corporate earnings results following a dismal report on employment on Friday.
Aluminum maker Alcoa becomes the first company in the Dow Jones industrial average to report its results later Monday, after the close of trading.
European markets were slightly higher.

WASHINGTON (AP) ? Sen. Chuck Schumer said Sunday he's hoping for a bipartisan deal by the end of this week on a sweeping immigration bill to secure the border and allow eventual citizenship to the estimated 11 million people living here illegally.
"All of us have said that there will be no agreement until the eight of us agree to a big, specific bill, but hopefully we can get that done by the end of the week," said Schumer, D-N.Y., who's leading efforts by eight senators to craft the legislation. "That's what we're on track to do."
Schumer spoke on CBS' "Face the Nation" alongside Sen. John McCain, R-Ariz., another leader of the immigration talks, who suggested there could be a tough road ahead for the contentious legislation.
"There will be a great deal of unhappiness about this proposal because everybody didn't get what they wanted," McCain said. "There are entrenched positions on both sides of this issue as far as business and labor."
A deal on immigration is a top second-term priority for President Barack Obama, and his senior adviser Dan Pfeiffer said Sunday that the bill being developed in the Senate is completely consistent Obama's approach ? even though the Senate plan would tie border security to a path to citizenship in a manner Obama administration officials have criticized.
Pfeiffer didn't answer directly when asked on "Fox News Sunday" whether Obama would sign legislation making a path to citizenship contingent on first securing the border, as negotiators in the Senate are doing. But he suggested Obama was supportive of the Senate plan.
"What they are looking at and what has been talked about in the Gang of Eight proposal is 100 percent consistent with what the president is doing so we feel very good about it," Pfeiffer said. "And they are looking at it in the right way."
Obama has stressed that a path to citizenship should not have major hurdles in front of it, and some immigration advocates believe that's what a requirement for a secure border would amount to. Obama's Homeland Security secretary, Janet Napolitano, has rejected the argument that border security must be achieved before a comprehensive immigration package or any pathway to legalized status can be done.
But Republicans involved in the Senate negotiations have made clear that border security is a must for them before those living here illegally can be allowed to move toward citizenship.
"We are going to secure that border and it will be tied to a pathway to citizenship or there will be no deal," Sen. Lindsey Graham, R-S.C., another negotiator on the bill, said Sunday.
Graham also suggested that disagreement over a new low-skilled worker program could still be hanging up an overall immigration deal ? even after an agreement a week ago between the AFL-CIO and the U.S. Chamber of Commerce.
The hard-won deal between labor and business would ultimately allow up to 200,000 workers a year into the U.S. to fill jobs in construction, hospitality, nursing homes and other areas where employers now say they have a difficult time hiring Americans or legally bringing in foreign workers. Even after the deal was struck, some industries, such as construction, continued to voice complaints about the terms.
Without offering details, Graham said on NBC's "Meet the Press" that negotiators were revisiting the low-skilled worker deal. But he issued a statement a short time later saying he was confident the agreement would hold.
Graham sounded optimistic overall, predicting the bill would pass the 100-member Senate with 70 votes in favor. Senators believe an overwhelming bipartisan vote is needed in the Democratic-led Senate to ensure a chance of success in the Republican-controlled House. Floor action could start in the Senate in May, Schumer said.
Meanwhile two lawmakers involved in writing a bipartisan immigration bill in the House, Reps. Luis Gutierrez, D-Ill., and Mario Diaz-Balart, R-Fla., sounded optimistic that they, too, would have a deal soon that could be reconciled with the Senate agreement.
"I am very, very optimistic that the House of Representatives is going to have a plan that is going to be able to go to a conference with the Senate in which we're going to be able to resolve this," Gutierrez said Sunday on CNN's "State of the Union".

A dormant, decade-old Mideast peace plan has suddenly emerged as a possible key to breaking years of deadlock between Israel and the Palestinians.
A top Palestinian official said Sunday that the visiting U.S. Secretary of State John Kerry has expressed interest in reviving the so-called Arab Peace Initiative, a 2002 plan in which the Arab world offered comprehensive peace with Israel in exchange for a full pullout from all territories it captured in the 1967 Mideast war. Arab officials confirmed the Arab League was set to discuss the matter on Monday.
The initiative was revolutionary when it was introduced by Saudi Arabia's then crown prince, King Abdullah, and later endorsed by the 22-member Arab League at a summit in Beirut. However, the plan was overshadowed by fierce Israeli-Palestinian fighting at the time and greeted with skepticism by Israel. The Arab League re-endorsed the plan in 2007, and technically, the offer remains in effect.
Key obstacles remain. Israel has not softened its objections to the plan, and the Palestinians turned down a request from Kerry for changes in it.
In the 1967 war, Israel took control of the West Bank, east Jerusalem, Gaza Strip, Sinai and Golan Heights. Israeli returned the Sinai to Egypt in 1982 in the framework of a peace treaty and pulled out of Gaza unilaterally in 2005. Israel annexed the Golan Heights in 1981, and peace talks with Syria over the territory have repeatedly failed.
Israeli-Palestinian peace talks have been deadlocked since late 2008, in large part over the issue of Israeli settlements in the West Bank and east Jerusalem. The Palestinians refuse to talk while Israel settles its population on the occupied territories where they want to establish their state. They have demanded that Israel accept the 1967 lines as the basis for a future Palestine. Israeli Prime Minister Benjamin Netanyahu rejects a return to the 1967 lines and calls for talks with no preconditions.
The 57-member Organization of Islamic Cooperation has also endorsed the 2002 Arab peace initiative.
The plan, if adopted, considers the Arab-Israeli conflict "ended," offers "normal relations" with Israel and calls for providing "security for all the states of the region."
Israel has rejected a return to the 1967 lines for both security and spiritual reasons. Israeli leaders have long argued that the 1967 frontiers are indefensible. In addition, a return to those boundaries would mean a withdrawal from east Jerusalem, home to the city's holiest Jewish, Muslim and Christian religious sites.
Israel has annexed east Jerusalem, and Netanyahu has vowed never to share control of the sensitive area. The Palestinians say there can be no peace without establishing their capital in east Jerusalem. These conflicting claims to east Jerusalem are perhaps the most emotional and explosive issue in the conflict.
Kerry on Sunday kicked off what is expected to be several months of shuttle diplomacy between Israel and the Palestinians with a stop in the West Bank for talks with President Mahmoud Abbas.
It was not immediately clear whether the Arab initiative came up in Sunday night's talks. A senior State Department official said the meeting "included a discussion on how to create a positive climate for negotiations," but that Kerry had asked all participants to keep the details confidential. The official spoke on condition of anonymity because of Kerry's orders not to brief reporters.
Abbas spokesman, Nabil Abu Rdeneh, said Abbas urged Israel to release Palestinian prisoners it is holding, called on Israel to halt settlement construction and urged Israel to commit to a solution based on the 1967 lines. He did not say whether the Arab peace initiative was discussed but confirmed Abbas was leaving Monday for talks on the plan at an Arab League meeting in Qatar.
Mohammed Subeih, the Arab League's undersecretary for Palestinian affairs, confirmed a special committee on the peace initiative would hold "an urgent meeting" in Doha on Monday.
He said the prime minister of Qatar would chair the meeting, and foreign ministers of key countries, including Egypt, Saudi Arabia, Jordan and the Palestinians, would attend. The Arab League's chief Nabil El-Araby is also expected, he said.
Subeih said the committee would form a delegation, chaired by El-Araby and the Qatari prime minister, to travel to Washington in the coming weeks. In Washington, the delegation will try together with the American side draw a road map to "end Israeli occupation," he said.
Earlier Sunday, the chief Palestinian negotiator, Saeb Erekat, said Kerry has been floating the Arab initiative as a possible way out of the deadlock.
Officials say Kerry has proposed two small changes to make it more palatable to Israel, saying the 1967 lines could be modified through mutual agreement and pressing for stronger security guarantees. Security-obsessed Israel has grown increasingly jittery during the upheaval that has swept through the Middle East over the past two years.
Speaking to the Voice of Palestine radio station, Erekat said the plan could not be changed. "Kerry asked us to change few words in the Arab Peace Initiative but we refused," he said.
Israeli officials refused to comment on the matter. An Israeli official said the Israelis were planning to offer "a wide spectrum of ideas" to Kerry when they meet with him in the current days. The official declined to elaborate. He spoke on condition of anonymity because nothing has been formally presented yet.
In the past, Netanyahu has described the Arab peace initiative as a welcome sign of acceptance from the Arab world but refused to accept it in its current form. Netanyahu has said that presenting the plan as an ultimatum would undermine negotiations.
But after years of deadlock, and growing international isolation over continued Israeli settlement construction, Netanyahu could find himself in a difficult position if the offer is again extended.?

?The Holy Father in particular asked that the congregation ? act with determination in cases of sexual abuse,? the Vatican said, referring to the Congregation for the Doctrine of the Faith, which handles such cases, after the pope met with its director.

MONTGOMERY, Ala. (AP) ? Opening a final chapter to one of the most important civil rights episodes in American history, Alabama lawmakers voted Thursday to allow posthumous pardons for the "Scottsboro Boys": nine black teens who were wrongly convicted of raping two white women more than 80 years ago.
The bill setting up a procedure to pardon the group must be signed by Gov. Robert Bentley to become law. He plans to study the legislation but has said he favors the pardons.
All but the youngest member of the group, whose ages ranged from 13 to 19, were imprisoned on death row after false accusations from the women and convictions by all-white juries. All were eventually freed without executions, although several suffered for many years in prison.
One, Haywood Paterson, escaped. While a fugitive, he helped publish a book about the case. Patterson was captured soon after, but the governor of Michigan refused his extradition to Alabama in 1950.
Over time, the case became a symbol of the tragedies wrought by racial injustice. It inspired popular songs, books and films. A Broadway musical was staged in 2010, the same year a museum dedicated to the case opened in Scottsboro.
The legal saga also set important legal precedents, including a Supreme Court decision that outlawed the practice of systematically excluding black people from juries.
The last of the men died in 1989.
The House approved the legislation Thursday morning in a 103-0 vote. The measure earlier passed the Senate 29-0.
"This is a great for Alabama. It was long overdue," said Democratic Rep. Laura Hall of Huntsville, who sponsored the bill in the House.
House Speaker Mike Hubbard, a Republican, said, "You can't change history, but you can take steps to right the wrongs of the past. The fact that this passed unanimously shows that today's 21st century Alabama is far removed from the one that caused such pain for so many so long ago."
That distance is still being measured.
Benjamin Todd Jealous, president and CEO of the NAACP, applauded the correction of "an historic miscarriage of justice." But he noted that Alabama is involved in a Supreme Court case over the Voting Rights Act and has passed laws that critics say are discriminatory against immigrants in the country illegally.
"Like so many communities that have had tried to move beyond their ugliest chapters, Alabama has learned you can only move forward if you are honest about your past," Jealous said. "It's heartening that this was a unanimous vote."
"Unfortunately," he continued, "Alabama still needs to confront its present."
Susan Glisson, executive director of the Institute for Racial Reconciliation at the University of Mississippi, also was gladdened by the measure. "It is an opportunity for us to understand that period, especially the ways in which blacks were deemed inferior and therefore not worthy of equal treatment before the law," she said.
But she found it ironic that it happened while Alabama is challenging its requirements under the Voting Rights Act, and said that the amount of time it took to pass may lead some to consider it an "empty gesture."
"For those of us who care about where our country's headed, I would hope we would take the opportunity to ask difficult questions about what reconciliation really means and also to understand the critical role that education and justice plays in its accomplishment," Glisson said.
The nine teens were accused of raping two white women on a freight train in Alabama in 1931. At this time during the Great Depression, many people would sneak aboard for free rides between cities. There had been a fight between whites and blacks on the train, and the two women made the false rape accusations in hopes of avoiding arrest.
The defendants were convicted in trials where, as was typical in such Deep South cases then, guilty verdicts were never in doubt. The Communist Party seized on the case as an opportunity to make inroads among black people and liberals. It got one of its lawyers named as defense counsel, and also secured the services of famed defense attorney Samuel Liebowitz. There were years of appeals ? some successful, as one of the women recanted and said their claim was a lie.
Supreme Court rulings related to the case guaranteed the right to effective counsel and barred the practice of keeping blacks off juror rolls.
The Senate sponsor of the legislation, Republican Sen. Arthur Orr of Decatur, credited Sheila Washington, founder of the Scottsboro Boys Museum, for pursuing the legislation after the governor and parole board said they didn't have the legal authority to issue pardons to the deceased.
Washington said the pardons would finally shine a light on "this dark injustice."
If the bill is signed into law, a petition would need to be filed for each of the men for each of them to be pardoned, said Eddie Cook, executive director of the state parole board. The parole board will then decide whether to grant the pardon. Previously, there had not been a procedure for pardoning someone who is dead.
Orr said it was unfortunate that the pardons are coming after all the Scottsboro Boys have died, but the legislation does let the state write a "better final chapter."
"Their lives were ruined by the convictions," he said. "By doing this, it sends a very positive message nationally and internationally that this is a different state than we were many years ago."

Perhaps by now the people of Pennsylvania are beginning to realize what a mistake they made in electing Pat Toomey to the U.S. Senate. Like most Republicans in Washington, he reflexively rejects everything President Barack Obama proposes. He supports the Ryan budgets, which voucherize Medicare, and he inexplicably champions austerity when the economy is weak, raising the specter of a double-dip recession like Britain's.
One of Mr. Toomey's worst acts is to vote for filibusters against President Obama's nominees for important federal positions. After four years in office, the president has not been able to fill many vital positions in the government because of Republican filibusters, meaning it takes 60 votes, not 51, to confirm an appointee.
Two years ago President Obama appointed Caitlin Halligan to the U.S. Court of Appeals for the District of Columbia. Although this highly qualified Princeton University-Georgetown Law School honors graduate has gotten a majority vote twice (54 and 51), filibusters have kept her off the court. In a letter to me, Mr. Toomey states: "I believe that Ms. Halligan is not qualified to serve on the United States Court of Appeals. ... Her record unfortunately reflects an ideological deviation from legal precedent and established constitutional principles."
This is standard stuff for anyone a Democratic president nominates these days. Mr. Toomey doesn't give one single example of her deviation from constitutional precedents. The real guiding principle of Republicans like Pat Toomey, I fear, is to make Mr. Obama fail by any means possible. Will Pennsylvanians let this obstructionist politician fool them again when he comes up for re-election?
